This website (www.tropicoolliving.com.au) is operated by Tropicool Life Pty Ltd (ABN 57 653 354 511), trading as Tropicool Living, a company registered in Queensland, Australia. Throughout these Terms, "we", "us" and "our" refer to Tropicool Life Pty Ltd trading as Tropicool Living.
By visiting our site and/or purchasing from us, you agree to be bound by these Terms and Conditions ("Terms"), together with our Privacy Policy, Shipping Information, and Returns & Refunds policy. These Terms apply to all visitors, customers, and users of this site.

We reserve the right to refuse service to anyone, at any time, for any lawful reason.

Section 3 — Product Information and Accuracy
We make every reasonable effort to ensure product descriptions, images, and pricing on this site are accurate. However, we do not guarantee that product descriptions, colours, or other content are error-free, complete, or current. Colours displayed may vary slightly depending on your device screen.
We reserve the right to correct any errors, inaccuracies, or omissions, and to update or change information at any time without prior notice, including after an order has been placed.
Section 4 — Pricing and Availability
All prices on this site are displayed in Australian Dollars (AUD) and are subject to change without notice.
We reserve the right to limit or refuse the sale of any product to any person, household, or order, at our sole discretion — including where we suspect fraudulent activity or reseller/bulk purchasing not intended for personal use.
We reserve the right to discontinue any product at any time.
Section 5 — Candle, Match, and Open-Flame Product Safety
Many of our products, including candles and matches, involve an open flame and carry inherent risks if not used correctly.
By purchasing these products, you agree to:
Read and follow all safety and usage instructions included with the product before use;
Never leave a burning candle unattended;
Keep lit candles and matches away from children, pets, flammable materials, and drafts;
Use products only for their intended purpose.
To the maximum extent permitted by law, Tropicool Life Pty Ltd (trading as Tropicool Living) is not liable for any injury, loss, or damage arising from the misuse of our products or failure to follow included safety instructions. Nothing in this section limits any consumer guarantee you are entitled to under the Australian Consumer Law (see Section 13).
Section 6 — Orders and Payment
By placing an order, you confirm that all information you provide (name, shipping address, payment details) is accurate and current.
We reserve the right to refuse or cancel any order, including where a product is listed at an incorrect price due to a technical or pricing error, where we suspect fraud, or where an order appears to be for resale or wholesale purposes. If we cancel an order after payment has been taken, you will receive a full refund for that order.
Section 7 — Email Marketing and Newsletter Sign-Up
If you subscribe to our newsletter (including via a sign-up discount offer), you consent to receive marketing emails from us in accordance with the Spam Act 2003 (Cth). Every marketing email we send will clearly identify Tropicool Living Pty Ltd as the sender and include a functional unsubscribe link. You may unsubscribe at any time, and your consent to receive marketing emails is never a condition of purchasing from us.

We are not responsible for the content, accuracy, or practices of any third-party site or service. Use of third-party tools is at your own risk, and you should review the relevant third party's own terms and privacy practices.

If you submit reviews, comments, or other content to us (for example, through product reviews or social media tags), you grant us a non-exclusive, royalty-free right to use, reproduce, and display that content in connection with our business and marketing, unless you tell us otherwise in writing.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. Where the ACL applies and permits us to limit liability, our liability is limited, at our option, to the replacement or repair of goods, or resupply of services.
Section 13 — Your Rights Under the Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Section 14 — Indemnity
You agree to indemnify Tropicool Life Pty Ltd (trading as Tropicool Living), our directors, employees, and agents against any claim or demand arising from your breach of these Terms or your violation of any law or third-party right.
Section 15 — Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
Section 16 — Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of this site will be subject to the exclusive jurisdiction of the courts of Queensland.
Section 17 — Entire Agreement
These Terms, together with our Privacy Policy, Shipping Information, and Returns & Refunds policy, constitute the entire agreement between you and Tropicool Life Pty Ltd (trading as Tropicool Living) regarding your use of this site, superseding any prior agreements or communications.
